Merissa Mist Moments Photography

Effective Date: March 01, 2025

This Photography Services Agreement ("Agreement") is entered into by and between Merissa Mist Moments Photography ("Photographer"), and the undersigned client ("Client"). By booking a session, the Client agrees to the following terms and conditions:

1. BOOKING & PAYMENT

  1.1. Client agrees to pay the full session fee at the time of booking to secure the session date and time.
  1.2. Wedding sessions may be eligible for a payment plan, subject to a separate written agreement.
  1.3. In the event the Photographer cancels the session, Client shall receive a full refund or the option to reschedule without additional fees.

2. CANCELLATION & RESCHEDULING

  2.1. Cancellations made within 24 hours of the scheduled session are non-refundable.
  2.2. Cancellations made 24-48 hours prior to the session are eligible for a 30% refund.
  2.3. Cancellations made 48+ hours prior to the session shall receive a full refund.
  2.4. Client may reschedule their session at no additional charge, subject to Photographer’s availability.
  2.5. Sessions may be rescheduled due to inclement weather at no extra charge, provided the Photographer deems it necessary.

3. LATE ARRIVALS & NO-SHOW POLICY

  3.1. Client agrees to arrive on time for the session.
  3.2. Any time lost due to late arrival shall not be extended or refunded. For example, if the Client arrives 30 minutes late to a 60-minute session, only the remaining 30 minutes shall be available.
  3.3. Failure to appear for a scheduled session ("No-Show") results in full forfeiture of the session fee.

4. WEATHER POLICY

  4.1. The Photographer shall not issue refunds due to weather conditions.
  4.2. Photographer may reschedule sessions in the event of unsafe weather conditions, at no additional charge to the Client.

5. PHOTO DELIVERY & USAGE

  5.1. Images shall be delivered via an online gallery where the Client may download and save them.
  5.2. Photographer offers on-site prints and mailed prints for an additional fee.
  5.3. A priority processing upgrade is available for a guaranteed 3-day turnaround, subject to an additional charge.

6. COPYRIGHT & USAGE RIGHTS

  6.1. Photographer retains full copyright ownership of all images.
  6.2. Client is granted a personal use license, allowing printing, sharing, and displaying of images for non-commercial purposes.
  6.3. Commercial use, publication, resale, or third-party distribution of images requires written consent from the Photographer.
  6.4. Photographer reserves the right to use images for promotional, portfolio, or marketing purposes unless the Client submits a written request                     otherwise.

7. LIABILITY & INDEMNIFICATION

  7.1. Photographer shall not be held liable for any injuries, property damage, or unforeseen circumstances before, during, or after the session.
  7.2. Photographer shall not be responsible for lost or stolen digital files after delivery.
  7.3. Client agrees to indemnify and hold harmless Merissa Mist Moments Photography from any claims, damages, or liabilities.

8. GOVERNING LAW & DISPUTE RESOLUTION

  8.1. This Agreement shall be governed by and construed in accordance with the laws of the State of Iowa.
  8.2. Any disputes arising from this Agreement shall first be resolved through mediation. If mediation is unsuccessful, legal proceedings shall take place in the appropriate courts within Iowa.

9. ENTIRE AGREEMENT

  9.1. This Agreement constitutes the entire understanding between the Photographer and Client and supersedes all prior agreements.
  9.2. Any amendments or modifications to this Agreement must be made in writing and signed by both parties.
